South Dakota, City of Oacoma and Lyman v. United States

South Dakota, City of Oacoma and Lyman v. United States

This case in federal district court challenges whether the United States properly took 90 acres of land into trust status outside the boundaries of the Lower Brule Reservation, and partially within the city of Oacoma, South Dakota.

The Lower Brule Sioux Tribe sought, but was denied intervention on the grounds that the Untied States adequately protected its interests. The Tribe appealed the denial of intervention, and that issue will be argued before the Eighth Circuit Court of Appeals in October, 2002.
