State v. Michael Kaufenberg
Kaufenberg was a contractor who pocketed about $25,000 in payments from Bill and Gerri Kaiser for real estate improvements in Brule County. He was sentenced today by Magistrate Judge Bruce Anderson. Pretty much pursuant to the plea agreement, Kaufenberg was sentenced to 180 days and a $1,000 fine. All of the jail time and $500 of the fine was suspended on the usual conditions, including 18 months probation during which Kaufenberg must make good on $25,000 restitution. Wage assignments of $500 per month were ordered, with the net balance to be satisfied out of proceeds of the sale of Kaufenberg’s Lake County home immediately upon closing. The restitution obligation and terms were reduced to a civil judgment, and that judgment was transferred to Lake County. There is now a judgment filed against Kaufenberg’s Lake County real property to satisfy his Brule County criminal restitution obligations. Kaufenberg will pay his $500 fine this month, and the wage assignments will begin in June. Meanwhile, Kaufenberg is closing on the sale of his residence this week, and net proceeds from the sale will be used early next week to satisfy the outstanding $22,750 restitution balence.
