Circuit Court Grants Sentence Modification for Gann Valley Woman in Manslaughter Case

 

PIERRE, S.D.-    Attorney General Marty Jackley announced today that Circuit Court Judge Bruce Anderson has granted defendant Donika Gonzales’ motion for a sentence modification.

 In 2014, Donika Gonzales, 25, Gann Valley, was convicted by a jury and sentenced to 130 years for first degree manslaughter and 15 years for aggravated assault for the death of a 4-year old child.

The Court reviewed the Pre-Sentence Report, the nature of the offenses, the Defendant’s strong efforts to rehabilitation in prison, as well as all of the other facts and circumstances in the case and the Court’s previous sentence, and has granted the Defendant’s motion to modify her sentence. The sentence is modified as follows:

On the first degree manslaughter count, the Defendant shall be sentenced to 90 years in the penitentiary, with 50 years suspended on the condition that she remains on good behavior. The aggravated assault count will not be amended and will run concurrent.  This sentence allows the Defendant to be parole eligible after serving 20 years of her sentence.
