Brookings County Man Indicted for Aggravated Battery of an Infant

PIERRE, S.D. – Attorney General Marty Jackley and Brookings County States Attorney Abigail Howard announced today that Allen T. Smith, 21, Brookings has been indicted on one count of aggravated battery of an infant, class 2 felony, punishable by up to 25 years in the state penitentiary and/or $50,000 fine and one count of abuse or cruelty to a minor, class 3 felony, punishable by up to 15 years in the state penitentiary and/or $30,000 fine.
Charges stem from an incident that occurred in a Brookings residence on or about January 30th, 2017.
Smith is presumed innocent until such time as proven guilty.
This case is being investigated by the Brookings Police Department and prosecuted by the Brookings County States Attorney and the Attorney General’s Office.
