PIERRE, S.D. – Attorney General Marty Jackley and the Division of Criminal Investigation today released the summary into the shooting of Cruz DeLeon, on July 31, 2017, in Box Elder, South Dakota. The Division of Criminal Investigation conducted the investigation at the request of the Pennington County Sheriff’s Office.
The incident occurred on July 31, during a warrant check at a Box Elder residence, when the situation escalated resulting in the deputy firing a duty weapon at the subject.
“It is my conclusion as Attorney General that Deputy Jakob Whittle was justified in firing his weapon and using lethal force. I would like to thank the Pennington County Sheriff’s Office and the Deputy for their service and complete cooperation in this investigation,” stated Attorney General Jackley.
