Burbank Man Arrested on Multiple Counts Including Aggravated Incest and Rape


PIERRE, S.D  -Attorney General Marty Jackley and Clay County States Attorney Teddi Gertsma  announced today that Joseph T. Night, 62, Burbank, was arrested on four counts of rape in the first degree, class C felony punishable by up to life in the state penitentiary, two counts of aggravated incest, class 3 felony punishable by up to 15 years imprisonment and/or $30,00 fine, two counts of sexual contact with a child under 16, class 3 felony  punishable by up to 15 years and/or $30,000 fine, two counts of sexual exploitation of a minor, class 6 felony punishable by 2 years imprisonment and/or a $4,000 fine, one count of simple assault domestic abuse, class one misdemeanor, one count of 3rd degree intentional damage to property, class 2 misdemeanor and one count of third degree interference with emergency communication, class 1 misdemeanor.

Charges stem from a call to service at a residence in Burbank on the evening of Sunday, May 3, 2013.

Night is presumed innocent until such time as proven guilty.

This case is being investigated by the Clay County Sheriff’s Office and the Division of Criminal Investigation.
