Division of Consumer Protection

The SD Division of Consumer Protection consists of an Assistant Attorney General, a director, four investigators,  and a complaint intake specialist, all of whom work under the direction of the Attorney General.

2011 Consumer Protection Stats

In 2011 the Division of Consumer Protection recovered $3,289,944 for consumers and 2,430 case files were opened. Division Investigators closed 2,005 case files. Approximately 17,655 calls were received by the Division. In addition, there were 4,746 Helpline inquiries/requests.

Duties & Responsibilities

 The major responsibilities of the Division of Consumer Protection are:                        

  • Investigate false, misleading, or deceptive trade practices         
  • Enforce consumer laws designed to protect the public and legitimate business community
  • Enforce statutes relating to buying clubs, telephone solicitation, telemarketing, and sweepstakes 
  • Advise consumers of their basic rights under consumer laws
  • Distribute consumer education materials
  • Assist in the preparation of legislation designed to protect consumers
  • Participate in multi-jurisdictional actions with other state and federal law enforcement agencies
  • Advise consumers of complaints on file against specific companies
