Minnesota Man Indicted for Sexual Abuse Charges in Marshall County

PIERRE, S.D. – Attorney General Marty Jackley and Marshall County States Attorney Dana Frohling announced today that a Marshall County grand jury has indicted Michael Donn Elsberry, 51, Braham, MN, charging him with one count of second degree rape, class 1 felony, punishable by up to 50 years in the state penitentiary and/or $50,000 fine, two counts of sexual contact with child under sixteen, class 3 felony, punishable by up to 15 years and/or $30,000 fine, two counts of domestic aggravated assault, class 3 felony, punishable by up to 15 years and/or $30,000 fine and one count of abuse of or cruelty to a minor, class 4 felony, punishable by up to 10 years in the state penitentiary and/or $20,000 fine.
Elsberry is presumed innocent until such time as proven guilty.
This case is being investigated by the Marshall County Sheriff’s Office and the Division of Criminal Investigation and prosecuted by the Marshall County States Attorney and the Attorney General’s Office.
