Human Trafficking and Sex Offense Forfeiture Bill Signed into Law

PIERRE, S.D –   Attorney General Marty Jackley extends his appreciation to the South Dakota Legislature and Governor Dennis Daugaard for signing SB 25 that will allow for the forfeiture of assets used in the furtherance of human trafficking and sex crimes after conviction.

“In an effort to strengthen South Dakota’s resolve to protect victims of sex crimes and human trafficking, this law will allow monies used in furtherance of these horrific sex crimes to be taken and used for preventive efforts and victims,” said Attorney General Jackley.

Consistent with the national trend, South Dakota has experienced an increase in sexual crimes including internet crimes against children and human trafficking affecting children. These forfeiture provisions provide protection for innocent third party assets and are modeled after South Dakota’s drug forfeiture scheme which has withstood repeated constitutional challenges.
