Requirements for Interagency Multidisciplinary Teams ("MDT's")

Effective July 1, 2018, members of interagency multidisciplinary teams ("MDT's) are required to sign a memorandum of understanding acknowledging the written procedures and guidelines for the MDT.  The memorandum of understanding must also include an information sharing and confidentiality agreement ("Confidentiality Agreement") approved by the Attorney General.  A list of the team members and the memorandum of understanding must be filed with the Office of Attorney General and, if the MDT is formed to investigate a crime involving a child victim (as defined in SDCL 23A-28C-4), with the South Dakota Department of Social Services.  For more information as to the requirements for an MDT, see SDCL 23A-28C-15,  http://www.sdlegislature.gov/Statutes/Codified_Laws/DisplayStatute.aspx?Type=Statute&Statute=23A-28C-15

The Attorney General has approved the following Confidentiality Agreement for attachment as an exhibit to the memorandum of understanding for the MDT.

Team members should direct questions regarding memorandums of understanding to their respective attorneys.

Filing:

Effective July 1, 2018, the above-described list of team members and the memorandum of understanding, with the attached Confidentiality Agreement, must be filed with the Office of the Attorney General and, if the MDT is formed to investigate a crime involving a child victim, with the Department of Social Services.
