Haan’s Lawsuit Against the Secretary of State Seeking Placement on Ballot for U.S. House of Representatives Dismissed
PIERRE, S.D – Attorney General Marty Jackley announced that Charles W. Haan had filed a lawsuit against Secretary of State Jason Gant to certify Haan as a candidate for the United States House of Representatives. Today the Circuit Court dismissed the lawsuit finding that the Secretary of State complied with state law, and Haan’s name will not appear on the November General Election ballot.
On August 27, 2014, the State Court dismissed an additional lawsuit filed by Haan against the Attorney General. The Court held that only the Secretary of State has the authority to certify candidates for elective office.
