Haan’s Lawsuit Against the Secretary of State Seeking Placement on Ballot for U.S. House of Representatives Dismissed
PIERRE, S.D – Attorney General Marty Jackley announced that Charles W. Haan had filed a lawsuit against Secretary of State Jason Gant to certify Haan as a candidate for the United States House of Representatives. Today, the Federal District Court dismissed the lawsuit finding that Haan failed to comply with South Dakota’s statutes regarding nomination. In affirming Gant’s decision, the Court upheld the constitutionality of the South Dakota’s statutes. With this ruling, Haan’s name will not appear on the November General Election ballot.
On September 5th the State Court likewise held that Haan had failed to comply with the South Dakota election requirements.
