Walker’s Federal Lawsuit Seeking Placement on Ballot for U.S. Senate Dismissed
 

PIERRE, S.D –   Attorney General Marty Jackley announced today that Federal District Court Judge Lawrence Piersol has dismissed Clayton G. Walker’s lawsuit to be placed on the November ballot as an independent candidate for United States Senate.

Walker argued that South Dakota’s petition requirements were unconstitutional and that petition filing deadline of April was too early.

The Court ruled from the bench, that Walker was not entitled to an injunction and that South Dakota petition requirements were constitutional. The Court will issue a written order as well.
Walker was indicted on June 17, 2014 for state election law violations. A motions hearing date has been set for November 18, 2014 in Hughes County. Walker is presumed innocent until such time as proven guilty.
