Attorney General Jackley Reminds Sirius XM Subscribers of May 4
Settlement Restitution Deadline
PIERRE, S.D – Attorney General Marty Jackley, along with the attorneys general of 44 states and the District of Columbia, entered a settlement agreement with Sirius XM Radio Inc. in December 2014 to pay $3.8 million to the states and to provide restitution to eligible consumers to resolve claims that the satellite radio company engaged in misleading advertising and billing practices. South Dakota's share in this settlement was $50,037.51.
The attorneys general allege that Sirius XM engaged in misleading, unfair, and deceptive acts or practices in violation of state consumer protection laws. To be considered for restitution under this settlement, consumers must file a complaint concerning conduct from July 28, 2008, to Dec. 4, 2014, involving an identifiable loss that has not been previously resolved.
Consumers who have not previously filed a complaint with their attorney general or with Sirius XM directly for the practices covered by this settlement were given 150 days after the settlement’s execution date to file a complaint to be considered for restitution. The deadline to file a complaint is May 4, 2015.
