PIERRE, S.D. – Attorney General Marty Jackley announced today that Gary Podzimek, 58, Bristol, has been indicted by a Day County Grand Jury on one count of grand theft by deception, class 4 felony, punishable by up to 10 years in the state penitentiary and/or $20,000 fine, one count of attempted grand theft by deception, punishable by up to 5 years in the state penitentiary and/or $10,000 fine and one count of deceptive act or practice, class 6 felony, punishable by up to 2 years in the state penitentiary and/or $4,000 fine.
The indictment charges that on or about August 21, 2015 through May 16, 2016, Podzimek did unauthorized and unnecessary mechanical work to a vehicle belonging to an 83 year-old Day County man.
Podzimek is presumed innocent until such time as proven guilty.
This case is being investigated by South Dakota Consumer Protection Division and the Day County Sheriff’s Office and prosecuted by the Attorney General’s Office.
