ATTORNEY GENERAL LARRY LONG ANNOUNCES A STAY FILED IN HB 1240

PIERRE, S.D.-  Attorney General Larry Long announces that a stay has been entered in the Hughes county circuit court delaying indefinitely the effective date of the smoking ban.  Circuit Judge Mark Barnett entered an order delaying the effective date of HB 1240 (Smoking Ban) pending the outcome of a lawsuit filed today by MIKE TRUCANO, DON ROSE, MARK O’NEILL and PETE THOMPSON against Chris Nelson, South Dakota Secretary of State.  

Long says that the stay will be in effect until resolution of the litigation.  A hearing date is expected quickly but has not yet been scheduled.
