PIERRE, S.D. – Attorney General Marty Jackley announced today that Thomas P. Lucero, Jr., 26, Sioux Falls, has been indicted by a Fall River County Grand Jury on one count of first degree murder, class A felony, mandatory life sentence in the state penitentiary or death, one count of second degree murder, class B felony, mandatory life sentence in the state penitentiary, and one count of aggravated assault, class 3 felony, punishable by up to 15 years in the state penitentiary and/or $30,000 fine.
“I want to thank the grand jurors for their service, the prosecutors and investigators for their tireless work on this case and the community for their assistance on this case,” said Jackley.
The indictment charges that on or about January 11, 2017, Lucero killed Moses Dubray. Dubray was found deceased along SD Hwy 89 on January 11, 2017. Dubray had been placed on escape status by the South Dakota Department of Corrections after walking away from his assigned unit on January 10, 2017.
Lucero was convicted on first degree robbery charges in 2013. He was paroled in 2015 and then violated the conditions of his parole. Lucero turned himself in on an active warrant as a parole absconder in January 2017 and is currently incarcerated at the state penitentiary.
Lucero is presumed innocent until such time as proven guilty.
This case is being investigated by the Fall River County Sheriff’s Office and the Division Criminal Investigation and prosecuted by the Fall River County State’s Attorney and the Attorney General’s Office.
