PIERRE, S.D. - Attorney General Marty Jackley confirms Gary Johnathan Martin, 35, Pierre, was indicted yesterday by a Hughes County Grand Jury on one count of aggravated battery of an infant, class 2 felony, punishable by up to 25 years in the state penitentiary and/or $50,000 fine and one count of abuse or cruelty to a minor, class 3 felony, punishable by up to 15 years in the state penitentiary and/or $30,000 fine. 

The indictment charges that on or about January 22, 2018, Martin assaulted his girlfriend’s 2 month-old son.

Martin is presumed innocent until such time as proven guilty.

The investigation is being conducted by the Pierre Police Department and being prosecuted by the Attorney General’s Office.
