Guericke Pleads Guilty to Falsification of Evidence in Gear Up Case

 

PIERRE, S.D. - Attorney General Marty Jackley announced today Danial Mark Guericke, 60, White Lake, has pled guilty to one count of falsification of evidence, class 6 felony, punishable by up to 2 years imprisonment in the state penitentiary and/or $4,000 fine.

 

“Defendant Guericke has accepted responsibility for his actions by entering a guilty plea to falsification of evidence as set forth in the indictment. As a condition of the plea, Guericke has agreed to cooperate with the further investigation and court proceedings in the Gear Up case,” said Jackley.

 

This case was investigated by the Division of Criminal Investigation and prosecuted by the Attorney General’s Office.

 

A sentencing date has been scheduled for November 26, 2018 at 1:30 p.m. (CST).  

 

The jury trial scheduled for co-defendant Stacy Phelps is scheduled to begin on October 3, 2018 in Sioux Falls.
