PIERRE, S.D. – Attorney General Marty Jackley and the Division of Criminal Investigation today released the summary into the shooting of Kuong Gatluak, 21, Vermillion, on September 16, 2018, in Union County, South Dakota.  The Division of Criminal Investigation, assisted by the Minnehaha and Union County Sheriff’s Office, conducted the investigation at the request of the South Dakota Highway Patrol.

The incident occurred on the evening of September 16, 2018, after the Vermillion Police Department responded to a call to service at a Vermillion residence that resulted in a vehicle pursuit. Vermillion Police Department discontinued the pursuit when speeds increased in a residential neighborhood.  A South Dakota Highway Patrol Trooper located the vehicle and initiated a traffic stop, when the situation escalated resulting in the Trooper firing their duty weapon at the subject.

“It is my conclusion as Attorney General that the Trooper was justified in firing their weapon and using lethal force. I would like to thank the South Dakota Highway Patrol and the Trooper for their service and complete cooperation in this investigation,” stated Jackley.
