Bon Homme County Trial Results In Guilty Verdict and Sentencing for State Prisoner

PIERRE S.D. - Attorney General Jason Ravnsborg announced today that Delano James Brafford was found guilty and sentenced today at the Bon Home County Courthouse to 4 years to the SD State Penitentiary, to run concurrent to his prior conviction out of Pennington County. 

Brafford was indicted on Count 1, Possession of Article of Indulgence, To-Wit: Marijuana, By an Inmate SDCL 24-2-14(1); 22-42-6 Class 6 Felony; Count 2, Ingesting Substance, Except Alcoholic Beverages, For the Purpose of Becoming Intoxicated SDCL 22-42-15 Class 1 Misdemeanor; Subject to Doubling SDCL 22-6-5.1 and 22-11A-1.

While a prisoner at the SD State Penitentiary, on May 20th, 2018, a UA was taken and tested positive for marijuana and an investigation commenced. It was then alleged that between the approximate dates of April 6, 2018, to and including May 20, 2018, Brafford, while a prisoner confined to the state penitentiary at the time of the offense, did intentionally ingest, inhale, breath or otherwise take into his body a substance, except alcoholic beverages for the purpose of becoming intoxicated, unless such substance was prescribed by a medical professional.

“I congratulate the Special Investigation Unit at the Mike Durfee State Prison on their outstanding work in this matter,” said Ravnsborg.

This case was investigated by the Special Investigation Unit at the Mike Durfee State Prison and prosecuted by the South Dakota Attorney General’s Office.
