Pennington and Aurora Counties' Drug Seizure

PIERRE, S.D.- 

   Attorney General Marty Jackley announces law enforcement’s seizure of marijuana valued at approximately $4,000,000.00 on Interstate 90 on April 8, 2010. Nathan R. Delgado and William R. Mitchell have been charged in Pennington County with one count of Conspiracy to Distribute more than One Pound of Marijuana under SDCL 22-42-7 and 22-3-8, a Class 4 felony carrying a maximum penalty of 10 years incarceration or $20,000 fine or both.  In Aurora County William R. Mitchell is charged with one count of Possession of more than Ten Pounds of Marijuana under SDCL 22-42-6, a Class 3 felony carrying a maximum penalty of 15 years incarceration or $30,000 fine or both. Mitchell is also charged with a count of Possession with intent to distribute one pound or more of Marijuana under SDCL 22-42-7, a Class 3 felony carrying a maximum penalty of 15 years incarceration or $30,000 fine or both. Delgado and Mitchell are presumed innocent until and unless proven guilty. The investigation is being conducted by the South Dakota Division of Criminal Investigation, South Dakota Highway Patrol, Pennington County Sheriff’s Office, and Aurora County Sheriff’s Office. The case will be prosecuted by the Attorney General’s Office, the Aurora County State’s Attorney John Steele’s office, and the Pennington County State’s Attorney Glenn Brenner’s Office.
