MOTION FOR CONTEMPT IN SIOUX FALLS QUALITY WATER CASE

PIERRE, S.D.-   Attorney General Marty Jackley announces that the Division of Consumer Protection has filed a Motion for Contempt in the State of South Dakota v. James A Lund and Sioux Falls Quality Water case.   The Division of Consumer Protection filed an action against Lund and Sioux Falls Quality Water June 12, 2006 alleging deceptive trade practices.  After a hearing Second Circuit Court Judge Tiede imposed injunctive terms, which were set forth in a consent judgment filed May 16, 2007.  The current motion alleges violations of the 2007 consent judgment, including Defendants’ continued unannounced sales and solicitation visits to homes of consumers without notification or permission as required by the judgment. A hearing on this matter will be held at the Minnehaha County Courthouse on June 10, 2010 at 1:30 pm.  Consumers who have questions or wish to file complaints should contact the Division of Consumer Protection at 1-800-300-1986.
