Attorney General Larry Long Reminds Employers to be Cautious of Labor Law Poster Scams
PIERRE, S.D. - Attorney General Larry Long is warning South Dakota employers about solicitations regarding labor law information. The solicitations state that federal law requires employers to purchase up-to-date labor law posters or risk of being fined for noncompliance. The solicitation then asks for fees of $49.99 and up for sets of the posters.
"There is federal law that mandates the posting of certain labor laws," said Long. "But they are available from the South Dakota Department of Labor at no charge. These letters are just a scare tactic used to make a buck."
The State of South Dakota requires two postings:
- Unemployment posting. Employers may obtain this by calling the Unemployment Insurance Division at 605-626-2312.
- Safety on the Job posting. The Workers' Compensation law requires employers to post information encouraging safety. There is no required format for this poster.

- Occupational Safety and Heath Act- OSHA
- Federal Minimum wage notice
- Employee Polygraph Protection Notice
- Employment Opportunity
- Family and Medical Leave Act of 1993
- USERRA
