PIERRE, S.D. – Attorney General Marty Jackley announces the South Dakota Supreme Court has upheld the convictions of a defendant despite claims of insufficient evidence.

This case was based on strong evidence at trial that the defendant was a dangerous criminal,” said Attorney General Jackley. “The investigators, trial and appellate lawyers have held him accountable and have kept our communities safer.”

Cory Bromley was arrested with another suspect for a robbery that took place March 1, 2025, in Alcester. Bromley was convicted on one count each of First-Degree Robbery, First-Degree Burglary, Commission of a Felony (Kidnapping) while armed with a Firearm, Second-Degree Kidnapping, and Petty Theft. He is serving 25 years in prison.

At Bromley’s trial, the State alleged Bromley had aided and abetted the crimes. The defense argued there was insufficient evidence that he had been involved. Bromley appealed his case to the South Dakota Supreme Court on the grounds there was insufficient evidence for convictions on all charges.

The Court ruled that the evidence presented at trial proved that Bromley had intended to be involved in the crimes and that he had not been merely “present” at the scene as argued by the defense. The Court stated that it was reasonable for the jury to determine that Bromley had aided and abetted the crimes.

South Dakota’s Attorney General’s Office represented the state at the appeal. The Supreme Court’s decision was unanimous.
