MITCHELL MAN INDICTED ON RAPE CHARGE
Attorney General Mark Barnett said that Allan Burns, 35, of Mitchell was indicted today by a Davison County Grand Jury on one count of 3rd degree rape. Burns has been arrested and is currently in custody at the Davison County Jail.
The rape charge is a class three felony, punishable by a possible fifteen-year penitentiary sentence and a fifteen thousand-dollar fine.
Burns is accused of raping a 15-year-old girl in Mitchell. The case is being investigated by the South Dakota Division of Criminal Investigation and the Mitchell Police Department, and prosecuted by the Attorney General’s Office.
