PIERRE, S.D.- Attorney General Marty Jackley confirms today that he received a letter and press release from the National Labor Relations Board advising that Constitutional Amendments recently passed in the states of Arizona, South Carolina, South Dakota and Utah violate federal labor law. Attorney General Marty J. Jackley says, “South Dakotans have spoken on this issue with the passage of a Constitutional Amendment guaranteeing the right to vote by secret ballot. As Attorney General, we will vigorously defend our South Dakota Constitution as we have done in the state court challenge to this Constitutional Amendment.”
The Constitutional Amendment at issue states in total:
Article XI, § 28. Right to vote by secret ballot. The rights of individuals to vote by secret ballot is fundamental. If any state or federal law requires or permits an election for public office, for any initiative or referendum, or for any designation or authorization of employee representation, the right of any individual to vote by secret ballot shall be guaranteed
