PIERRE, S.D. - Attorney General Marty Jackley announced today that Gabriel D. Medicine Eagle Jr., 34, Winner, was convicted by a Tripp County jury on 4 counts including: rape in the second degree, a class 2 felony with a maximum penalty of twenty-five years in the state penitentiary, rape in the third degree, a class 3 felony with a maximum penalty of fifteen years in the state penitentiary, sexual contact with a child under age sixteen, a class 3 felony with a maximum penalty of fifteen years in the state penitentiary and kidnapping, a class 1 felony with a maximum penalty of fifty years in the state penitentiary on October 18, 2011. The arraignment for habitual offender charges will be held on October 28, 2011, in Winner.
The case stemmed from an allegation that Medicine Eagle kidnapped and raped a juvenile in the Winner area in September of 2000.
This case was investigated by the Division of Criminal Investigation and the Tripp County Sheriff’s Office and prosecuted by the Attorney General’s Office. Sentencing in this case is scheduled for January 5, 2012, in Tripp County.
