No Criminal Prosecution in Mike Durfee State Prison Altercation



PIERRE, S.D. – Attorney General Marty Jackley and Bon Homme County States Attorney Lisa Rothschadl announced that there will be no criminal prosecution at this time against inmate Kendall Osteen for the incident that occurred at Mike Durfee State Prison on November 15, 2011.  
 
After further investigation, including review of video footage, five prosecutors from the Attorney General’s Office including Attorney General Jackley, as well as States Attorney Rothschadl, determined that the evidence does not justify criminal prosecution in part based upon self-defense. This determination included dismissal of the initial simple assault charges that followed the incident.
