Moody County Officer Involved Shooting Summary


PIERRE, S.D.  – Attorney General Marty Jackley and the Division of Criminal Investigation today released the summary into the shooting of Robert Nosbusch on February 16, 2012, in rural Moody County, South Dakota.
 
The Division of Criminal Investigation, assisted by the Flandreau Police Department and the South Dakota Highway Patrol conducted the investigation at the request of the Moody County Sheriff’s Office.
 
The incident occurred on February 16, 2012, following a call for service in the rural Moody County. After Nosbusch failed to follow repeated commands, and began walking towards the Officers and a third party with his handgun pointed toward them, Deputy Bowden had little choice but to fire his duty weapon in defense of himself and the third party.

It is the conclusion of this report and the Attorney General that Moody County Sheriff Deputy Nathan Bowden was justified in firing his weapon and using lethal force. The Attorney General would like to thank the Moody County Sheriff’s Office and the Officers for their service and complete cooperation in this investigation.
