Sioux Falls Man Sentenced for Conduct towards Disabled Child

PIERRE, S.D.-    Attorney General Marty Jackley announced today that Marshall Dillon Lee Peterson, 24, Sioux Falls, was sentenced earlier this week to serve 14 days in jail for assaulting a disabled child.

Charges stemmed from an incident of simple assault that occurred on January 23, 2012, while Peterson was employed at a healthcare facility in Sioux Falls.

In addition to the 14 days in jail, Second Circuit Magistrate Court Judge John R. Hinrichs suspended the imposition of sentence, and placed Peterson on probation for three years. Judge Hinrichs stated that he imposed jail time to send a message that this type of conduct by caregivers will not be overlooked.
The case was investigated and prosecuted by the South Dakota Medicaid Fraud Control Unit, with assistance from the Department of Human Services, the Department of Social Services, the Sioux Falls Police Department, the Minnehaha County Sheriff’s Office, and the Minnehaha County Office of State’s Attorney.
