PIERRE, S.D.- Attorney Marty Jackley announced today that Clinton James Brown, 35, Presho, was indicted today by a Lyman County grand jury.
Brown was indicted on 14 felony charges and 3 misdemeanor charges, including:
- 1 count -Attempted murder 2nd degree, class 2 felony, maximum sentence of twenty-five years imprisonment and/or $50,000 fine.
- 1 count- Aggravated kidnapping 1st degree, class B felony, mandatory life sentence in state penitentiary.
- 1 count- Aggravated kidnapping 2nd degree, class 1 felony, maximum sentence of fifty years of imprisonment and/or $50,000 fine.
- 3 counts- Aggravated Assault-Domestic Abuse, class 3 felony, maximum sentence of fifteen years imprisonment and/or $30,000 fine.
- 1 count- Abuse or Cruelty to a minor, class 4 felony, maximum sentence of ten years imprisonment and/or $20,000 fine.
- 5 counts -Commission of a felony while armed with firearm, class 2 felony, maximum sentence of twenty-five years imprisonment with minimum 5 years and/or $50,000 fine.
- 1 count- Possession of a firearm by felon, class 6 felony, maximum sentence of two years imprisonment and/or 4,000 fine.
- 1 count- Possession of a controlled substance, class 4 felony, maximum sentence of ten years imprisonment and/or $20,000 fine.
- 1 count- Possession of Marijuana, class 1 misdemeanor.
- 1 count- Ingesting a substance for the purpose of becoming intoxicated, class 1 misdemeanor.
- 1 count- Possession of Drug Paraphernalia, class 2 misdemeanor.
Charges stem from incidents that occurred on August 15 and August 17, 2012 in rural Lyman County. Brown is presumed innocent until such time as proven guilty.
The investigation is being conducted by the Lyman County Sheriff's Office, South Dakota Highway Patrol and the Division of Criminal Investigation.
