Charges Filed in Assault at the State Penitentiary

 
PIERRE, S.D.-  Attorney General Marty Jackley announces that a Complaint has been filed charging inmate Carlos Rapheal Green, 28, Sioux Falls, with one count of aggravated assault against a department of corrections employee, class 2 felony, maximum sentence of twenty-five years imprisonment and/or $50,000 fine and inmate Garrett Austin Dumarce, 24, Sioux Falls, with one count of aiding, abetting or advising aggravated assault against a department of corrections employee, class 2 felony, maximum sentence of twenty-five years imprisonment and/or $50,000 fine. In conjunction with the Habitual Offender filing, Green faces up to life imprisonment and Dumarce faces up to fifty years imprisonment.

The charges stem from an incident that occurred at the South Dakota State Penitentiary on April 20, 2013, which resulted in Corporal Zane Mathis being hospitalized for treatment for a fractured jaw and facial lacerations.

Green is currently serving a 35 year sentence for aggravated assault, a consecutive 5 year sentence for eluding a police officer and a consecutive 2 year sentence for sliming. All of the sentences are from Brown County. Dumarce is currently serving a 5 year sentence for grand theft committed in Roberts County.

Green and Dumarce are presumed innocent until such time as proven guilty.
 
The case continues to be investigated by the Division of Criminal Investigation and is being prosecuted by the Attorney General’s Office.
